These Community Guidelines (“Guidelines”) govern Your use of our ‘Youthesta’ website/mobile application (“Platform”) that is operated by the Department of Journalism & Mass Communication-Behala College.
Youthesta (The Department of Journalism & Mass Communication-Behala College) operates the Platform as an Intermediary under the IT Act. This document is published in accordance with the provisions of the Information Technology Act of 2000 read along with its relevant rules including Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 and Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and amendments if any.
Please read these Guidelines carefully before viewing or posting Content on this Platform. By viewing or posting any Content on this Platform, You agree to be bound by the terms and conditions of these Guidelines.
This Policy shall form part of the Terms of Use and shall come into effect from the date on which the Terms of Use come into effect. You are bound by the Terms of Use, Privacy Policy and this Content Policy when You begin Your use of the Platform.
The Platform facilitates aggregation of Content from various sources. Youthesta merely provides access to various types of content as an intermediary.
Our mission is to give the students the power to learn, share and make the world more accessible and connected. Every day, students come to our Platform to share their stories, see the world through the eyes of others and connect with friends and causes.
We want users to feel safe when using our Platform. For that reason, we’ve developed a set of Community Guidelines, outlined below. These policies will help you understand what type of sharing is allowed on the Platform, and what type of content may be reported to us and removed.
For the purpose of this Policy/ Agreement (“Policy”), Content shall mean any material including but not limited to text, images, audio, a video displayed, broadcasted, published, hosted, communicated to the public on the Platform. For clarity, Content shall also include comments and hyperlinks.
When You use the Platform, You agree to all terms of our Policy, Terms of Use and Privacy Policy. If You disagree with any of these terms, please stop using the Platform.
You agree to post content in good faith only for lawful and non-commercial purposes including education, entertainment, criticism, or spreading information.
You must not access or post content through any unauthorized means, including but not limited to, by using an automated device, script, bot, spider, crawler or scraper.
Don’t post any content with bad intentions or use unauthorized means to post content on the Platform.
You agree that the content posted by You is legal and does not violate any applicable laws, rules, regulations, policies, guidelines and/or norms applicable to the Content in countries where the Content is published, communicated to the public, or distributed by Youthesta. You confirm that You are authorized to post the content on the platform. Youthesta can remove any Content in its sole discretion, with or without notice to users. Youthesta wants to make it easy for users to find news from publishers who consistently produce independent and original work, with a significant source of fresh and purposeful content.
The Content and behaviour policies help ensure a positive experience for our users and content creators. To be eligible to appear on the Platform content should follow the best practices such as per our policies and content should not be:
Treat others on the Platform with dignity, respect, and a sense of empathy. We encourage valid and well-intentioned expressions of healthy disagreement on the platform. We do not allow any forms of hateful, personal attacks, ad hominem speech, or uncivil disagreement which are intended to harm another user or cause them mental stress or suffering. Examples of hateful or discriminatory speech include comments which encourage violence, racially or ethnically objectionable, or disparage anyone based on their national origin, sex, gender identity, sexual orientation, religious affiliation, disabilities, or diseases. We also prohibit content which could encourage other users to share such content. You are not permitted to use hateful images or symbols in your profile image or profile header. You also may not alter your username, display name, or profile bio in such a manner as to appear as if you are engaging in abusive behaviour, or which could be reasonably construed as causing harassment to other user(s) or expressing hate.
You must always be respectful of the religious faith and beliefs of others regardless of whether or not they share the same views or beliefs as you. You must not publish anything which is hurtful to the sentiments of others, or which insults their religion or customs.
Youthesta prohibits the publication and promotion of Political Content (news, blog, podcast, video) on this platform. Political Content that is sensitive and directly criticize the government or content which promotes Anti-National attitudes are strictly prohibited on this platform. As this platform is a part of an educational institution and its sole purpose is to educate and build media literacy among people, we believe this type of content is completely unnecessary for this platform.
You must not threaten or promote any dangerous activities on the Platform. In particular you must not use the Platform to incite terrorism, secession, acts of violence against person or property or which threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign nations, or insults another nation. You must not post any content that promotes or encourages users to take actions on behalf of a terrorist or anti-national organization, or recruits and disseminates information for, or furthers the objectives of, such organizations. You must also not garner support or approval for the commission of violent acts during lawful protests or create violence-inducing terror and conspiracy networks on the platform.
We don’t allow audio, video, or image content that’s been manipulated to deceive, defraud, or mislead by means of creating a representation of actions or events that verifiably didn’t take place. This includes if such content would cause a reasonable person to have a fundamentally different understanding or impression, such that it might cause significant harm to groups or individuals, or significantly undermine participation or trust in electoral or civic processes. Users must refrain from using artificial or manipulative ways to generate traffic or to increase their followers or views, comments as well as shares.
You must not use the Platform to make any direct or indirect threats of physical harm against another person. This includes any threat relating to theft, vandalism, wrongful confinement, bodily, mental or financial harm. The Platform does not permit its users to post content which involves references to mass murder, violent events, or specific means of violence, in particular where vulnerable communities or groups are the primary targets or victims, or which depicts or glorifies any such actions. Platform does not permit the glorification of violence in any manner including but not limited to celebrating events that have caused physical harm to or hurt the sentiments of any person or group. You must refrain from posting content which depicts torture, injury, mental suffering, death, bodily harm, abduction, kidnapping or other forms of violent content.
Youthesta prohibits or block any sexual or suggestive content involving minors or someone who appears to be a minor. This includes child sexual abuse imagery, child pornography, and any other content, including fantasy content (e.g. stories, “loli”/anime cartoons), that depicts, encourages or promotes pedophilia, child sexual exploitation, or otherwise sexualizes minors or someone who appears to be a minor. Eterno has zero tolerance towards any material that promotes child sexual abuse content and other such content that include articles, posts/graphic posts as well as comments. Any users posting such content pertaining to child sexual abuse which aim to victimize, endanger, or otherwise exploit children.
Users should feel safe to express themselves so we don’t allow bullying or harassment content. We intend to give our users the freedom to express their opinions without fear of emotional or psychological distress. We also do not tolerate abusive content or behavior on our platform.
Youthesta expects users to be respectful towards the privacy of others. You must refrain from publishing, sharing, or encouraging the publication of any personal information of another person or which is an invasion of their policy. Without their express authorisation and permission. We also prohibit threatening to expose private information to do so.
You may not post media that is excessively gory or share violent or adult content within images, articles or comments. The media depticiting sexual violence or assualt is not permitted. Youthesta does not allow any kind of content i.e., non-consensual sexual act or shares any non-consensual sexual act intimate imagery or adult sexual solicitation.
Do not impersonate or pose as another person, brand, or organization to deceive or misleads users about the origin of the content. You are encouraged to voluntarily verify yourself and ensure that all the details provided in your profile are accurate and do not, in any manner, constitute misrepresentation.
We do not allow content that is excessively gruesome or shocking, especially that promotes or glorifies abject violence or suffering. We do allow exceptions for certain circumstances, for example, content that is newsworthy or meant to raise awareness about issues. When we identify a genuine risk of violence or threat to public safety, we ban the account and work with relevant legal authorities as necessary and when appropriate.
Do not knowingly post or share information, which is unverified or false or misleading, but may be perceived as factual. We have a zero-tolerance policy for morphed or manipulated media, including photoshopped pictures or doctored videos. We do not condone content which may affect citizen-centric processes. We also do not permit any content which may interfere with the results of political elections. You must, to the extent possible, make sure that the content that you post on the Platform is authentic and from a reliable and verifiable source.
We prohibit the trade, sale, promotion, and use of certain regulated goods, as well as the depiction or promotion of criminal activities. Some content may be removed if it relates to activities or goods that are illegal or regulated in the majority of the region or world, even if the activities or goods in question are legal in the jurisdiction of posting. We allow exceptions for content that provides value to the public, such as educational, scientific, artistic, and newsworthy content.
Please ensure that the content posed by You is not illegal, immoral or unethical.
Any content promoting or selling weapons, firearms, explosives, illegal goods or services, regulated goods, drugs, controlled substances, soliciting or selling sexual services is not allowed on the platform and is strictly prohibited.
Content that is related to or encourages money laundering or gambelling are strictly prohibited.
Content containing computer viruses, malware, or any other kind of computer code aimed at restricting the functionality of a computer resource is not allowed to be uploaded on the Platform.
You acknowledge, confirm and agree that Youthesta retains the right to monitor all content posted by You. You acknowledge and agree that, in case of any breach of applicable laws or the terms of this policy, You will be solely responsible for any consequences arising out of such breach. You acknowledge, confirm and agree that Youthesta may if notified by any third party or otherwise becomes aware of and determines in its sole discretion that the Content or any portions thereof:
Youthesta may remove the content if it violates any of the terms of this Policy.
You acknowledge, confirm and agree that all intellectual property rights in the Content You post vests with You or You have a valid license to post, display, reproduce, make copies, broadcast, communicate to the public such Content on the Platform.
You acknowledge, confirm and agree that all intellectual property rights in the Platform, whether registered or unregistered, including but not limited to its software, interface, webpages, database, name and logo vest in Youthesta. You shall not claim any right in any of the aforementioned forms of intellectual property.
You own the content posed by You. Youthesta owns all the rights in the Platform.
When You post content on the Platform, You grantYouthesta a non-exclusive, perpetual, worldwide, transferable, irrevocable, royalty-free, unlimited license to use, commercially use, cache, store, publish, display, distribute, and store such Content, including underlying works in the content, posted by You. You agree, understand and confirm that You are liable to pay any license fee, royalty, or any other consideration applicable to the content posted by You.
You grant Youthesta a right to use the content posed by You on the Platform.
Other than as expressly set forth in this Policy, You shall not copy, modify, publish, transmit, upload, participate in the transfer or sale of, reproduce (except as provided in this Section), create derivative works based on, distribute, perform, display, or in any way exploit, any of the Content, software, materials, or Services in whole or in part.
Do not use any content posted on the Platform for unauthorized purposes.
If You remove any Content from the Platform or terminate Your use of the Platform, Youthesta may keep and use Your Content on its sole discretion and for any lawful purpose. Youthesta and its users may retain and continue to use, store, any of Your Content even after the date of termination of Your use.
Youthesta retains the right to use content even after You remove it from the Platform.
You represent, covenant and warrant that the content posted by You does not violate any term of this Policy or any law in force in the territory in which You are posting the content or any law in force in the territory in which content can be displayed, broadcasted, published, used, communicated to public, reproduced or copied.
You further represent, covenant and warrant that You own or have a valid license to post the content, including underlying works in the content, on the platform and fulfil Your obligations under this Policy.
You confirm that the Your post is legal and You have a right to post it.
Youthesta makes no warranties under this Policy. And Youthesta expressly disclaims all warranties, expressed or implied, including but not limited to:
express or implied warranties of merchantability, fitness for a particular purpose and non-infringement with respect to the Platform(s) or any other aspect;
Warranties with respect to the any and all content;
warranties as to the quality or performance of the Platform(s), services, technology including but not limited to the availability of any advertisement; and
warranties that the Platform(s) and/or the services offered by it will be uninterrupted, timely, or error-free.
Youthesta makes no warranties with respect to the Platform.
You will indemnify and hold Youthesta and its affiliates, harmless, including costs and attorneys’ fees, harmless from any claim or demand made by any third party arising out of or in connection with the Content posted by You, any violation of this policy by You, or any other illegal act done by You.
If Youthesta is sued because of anything You do on the Platform, you have to pay the costs.

1.1. Youthesta-Behala College hereby grants You a Non-Exclusive, non-transferable and limited License to access and use the Platform on mobile phones, portable devices, or any other technology.
1.2. You agree, undertake and confirm that You are only permitted to use the Platform for accessing the Content.
1.3. Youthesta-Behala College provides You the option to search and select the Content accessible through the Platform, but does not warrant the correctness, authenticity, or validity of the content.
1.4. In order to access the latest Content, You are required to have access to an uninterrupted internet connection.
1.5. You hereby agree and acknowledge that nothing contained in this Agreement constitutes an obligation on the part of Youthesta-Behala College to offer or provide Content as mentioned herein. Youthesta-Behala College may at its sole discretion disable access to the content without any notice.
1.6. You hereby acknowledge and concede that the use, access and availing the facilities of the Platform shall also be governed by the Terms of Use, Community Guidelines and Privacy Policy of Youthesta-Behala College . You hereby agree that you shall be bound by the Terms and Conditions and Privacy Policy and shall act in accordance with the said documents.
1.7 While posting content to the Platform, You hereby agree and acknowledge that you shall strictly adhere to the provisions relating to User Generated Content in the Youthesta-Behala College Terms of Use.
2.1. You hereby agree, undertake and confirm that use of the Platform shall be subject, including without limitation, to the following conditions:
2.1.1. You shall use the Platform through its installation only in a single mobile or computer device at a time.
2.1.2. You shall not attempt to Reverse Engineer, Decompile or Descramble or use the Platform in any manner to understand the process, structure or working of the Platform or to otherwise reduce the Platform to a human perceivable form.
2.1.3. You shall not modify, network, rent, lease, loan, sell, distribute or create derivative works based upon the Platform in whole or in part. You shall not at any time make the Platform available to multiple users through any networking, terminal access, downloading, internal time sharing or similar arrangement or otherwise.
2.1.4. You shall not collect or harvest or attempt to harvest or collect personal data of other users who are using the Platform. You shall not transmit any viruses, worms, defects, Trojan horse, cancel bots, spyware, other items of a contaminating or destructive nature, denial of service attacks, adware, packet or IP spoofing, forged routing or electronic mail address information or similar methods or technology harmful code, flood pings, malware, bot, time bomb, worm, or other harmful or malicious component, which or might overburden, impair or disrupt the Platform , or which does or might restrict or inhibit any third-party user’s use and enjoyment of the Platform.
2.1.5. You shall not alter or remove, attempt to alter or remove any trademark, copyright or any other proprietary or legal notices contained in, or appearing on, the Platform or any other contents appearing on the Platform. You shall not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, content, music, text, page layout, or form) of Youthesta-Behala College and its affiliates.
3.1. You hereby agree, undertake and confirm that all right, title and interest in the Platform is retained by the Department of Journalism and Mass Communication of Behala College and that this Agreement only licenses your use of the Platform subject to the terms and conditions of the Agreement. You hereby confirm that this Agreement does not amount to transfer of any proprietary property by Youthesta-Behala College to You, and that all right, title, and interest in the property continues to vest with the Department of Journalism and Mass Communication of Behala College.
4.1 The copyright, trademark, patent or other intellectual property rights in the contents of the Platform (including, without limitation, all designs, logos, names, text, sound recordings, music, images, graphics, video and links) are licensed to operated by Youthesta-Behala College or the respective third-party entities as identified on the Platform. No license or right is granted, and use of the Platform therein shall not constitute by implication, estoppel or otherwise, any license or right of use. As such, You shall not reproduce, transmit, republish, upload, post, perform, broadcast, adapt, parody, distribute, display, license and/or alter in whole or in part any of the foregoing in any manner without the express permission of the Department of Journalism and Mass Communication of Behala College.
5.2 You shall not download or encourage others to download copyrighted works, trademarks, or other proprietary information without obtaining the prior written consent of the owner of the Intellectual Property. In the event of infringement, Youthesta-Behala College may on its own sole discretion to take necessary steps to remedy the same.
5.1. You hereby agree that You shall not disclose any confidential information to any third party about the Platform or Youthesta-Behala College which You have come into possession by virtue of downloading, installing, accessing or using the Platform, or in any other manner. You also agree that in any event, if such confidential information is disclosed by User(s) in violation of this Agreement, Youthesta-Behala College may on its own sole discretion, terminate this Agreement by deleting Your Accounts, without any notice to You, or to take any other legal measure which is considered reasonable and legitimate.
5.2. In the event You are aware that the Confidential Information is passed to any third party, You shall immediately inform Youthesta-Behala College regarding the same.
6.1. The Platform and information on it are provided by Youthesta-Behala College “as is” and on an “as available” basis and Youthesta-Behala College and its affiliates, make no warranties and hereby disclaim any express or implied warranties, including, but not limited to, the implied warranties (collectively, “warranties”) of merchantability and fitness for a particular purpose. In no event shall Youthesta-Behala College or its affiliates be liable for any direct, indirect, incidental, special, exemplary, or consequential damages (including, but not limited to, loss of use, data, or profits; or business interruption) however caused and on any theory of liability, whether in contract, strict liability, or tort (including negligence or otherwise) arising in any way out of the use of this Platform, even if advised of the possibility of such damage.
6.2. The content accessible by You through Your use of the Platform includes materials that belong to third parties. You acknowledge that Youthesta assumes no responsibility for such content.
6.3. Youthesta-Behala College makes no representations or guarantees that the Platform will be free from any bugs, viruses, Trojan horses, or the like which may be transmitted to or through our Platform by any third party, and/or any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any contents accessed by You through the Platform.
6.4. Youthesta-Behala College does not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the use of the Platform or any hyperlinked services or featured in any banner or other advertising, and Youthesta-Behala College will not be a party to or in any way be responsible for monitoring any transaction between You and third-party providers of products or services. As with the purchase of a product or service through any medium or in any environment, You should use best judgment and exercise caution, interference, personal injury or property damage, of any nature whatsoever, resulting from the access to and use of the Platform, hacking, or other security intrusion by You , and Youthest- Behala College disclaims any liability relating thereto.
6.5. Youthesta-Behala College makes no guarantees, representations, or warranties that use or results of the Platform will be accurate, timely, reliable, uninterrupted, or without errors. Without prior notice, Youthesta-Behala College may modify, suspend, or discontinue any part or all of the Platform or Your use of the Platform. In such event, Youthesta-Behala College will not be liable to You or any third party.
7.1. You hereby agree, undertake and confirm to receive advertisements through use of this Platform.
7.2. Youthesta-Behala College may provide access to third party websites on its Platform. Youthesta-Behala College is not responsible for any third-party content, including but not limited to texts, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music and artwork or applications, services, advertisements, and/or links that may be contained in the Platform.
7.3 Youthesta-Behala College may provide access on its Platform to third-party websites such as image compressor and other.Youthesta-Behala College does not own or control these third-party websites or services.
7.4 If You have any complaints or concerns regarding third-party content or third-party activities on the platform, You agree to report your complaints through the takedown process. You further agree and acknowledge that Youthesta-Behala College will handle Your complaints in accordance with its Takedown Policy and the applicable law.
8.1. While You are accessing, availing and/or using the Platform, Youthesta-Behala College may collect some of Your personal information and data. Such information is only collected with respect to various activities relating to the Platform and for no other purpose whatsoever. You may read Youthesta’s Privacy Policy for more information.
9.1. This Agreement shall commence on the date You accept the agreement and shall remain in full force and effect while You use and access the Platform.
9.2. You have the right to terminate this Agreement by deleting or uninstalling the Platform at Your sole discretion.
9.3. You hereby agree that Youthesta-Behala College reserves the right, in its sole discretion, to terminate this Agreement by deleting the Your user Account, without any notice to You, for any reason that may also include violation of any terms of the Agreement by You.
9.4. On termination of Your account, any and all user content, information existing in Your account or any and all activity from Your account shall be irretrievably deleted. However, certain details shall be maintained with Youthesta-Behala College for archival and legal purposes.
9.5. Both Parties hereby agree, undertake and confirm that provisions relating to Intellectual Property, Confidentiality, Representations and Warranties, Indemnity, Liability, and other provisions which by nature survive the termination of the Agreement shall survive the expiration or termination of the Agreement.
THE PLATFORM AND ALL CONTENT ACCESSIBLE THROUGH THE PLATFORM, ARE PROVIDED “AS IS”, “AS AVAILABLE”, AND “WITH ALL FAULTS”.
You hereby agree to indemnify, defend and hold Youthesta-Behala College and the Department of Journalism & Mass Communication, Behala College and its affiliates and the teachers, developers, harmless from and against any and all damages, liabilities, costs and expenses, including attorney’s fees and expenses, arising out of, incident to, or resulting directly or indirectly from the use of the Platform in a manner inconsistent with this Agreement. Notwithstanding its reasonable efforts, Youthesta-Behala College cannot take responsibility or control the Content accessed by You through the Platform.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL YOUTHESTA-BEHALA COLLEGE OR ITS AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES, FOR LOSS OF PROFITS OR CONFIDENTIAL OR OTHER INFORMATION, FOR BUSINESS INTERRUPTION, FOR PERSONAL INJURY, FOR LOSS OF PRIVACY, FOR FAILURE TO MEET ANY DUTY INCLUDING OF GOOD FAITH OR OF REASONABLE CARE, FOR NEGLIGENCE, AND FOR ANY OTHER PECUNIARY OR OTHER LOSS WHATSOEVER ARISING OUT OF OR IN ANY WAY RELATED TO THE USE OR INABILITY TO USE THE PLATFORM AND ANY LOSS OR DAMAGE ARISING OUT OF OR IN RELATION TO ACTS OF GOD OR ACT OF THIRD PARTY THAT IS BEYOND THE CONTROL OF ETERNO OR ITS AFFILIATES.
If any provision in this Agreement becomes invalid or illegal or adjudged unenforceable, the provision shall be deemed to have been severed from this Agreement and the remaining provisions of this Agreement shall not, so far as possible, be affected by the severance.
The failure of Youthesta-Behala College to enforce at any time any of the provisions of this Agreement shall not be construed to be a waiver of its right, power, privilege or remedy or as a waiver of any preceding or succeeding breach on Your part to this Agreement nor shall any single or partial exercise of any right power privilege or remedy preclude any other or further exercise of such or any other right power privilege or remedy provided in this Agreement all of which are several and cumulative and are not exclusive of each other or of any other rights or remedies otherwise available to Youthesta-Behala College at law or in equity.
The performance of any part of this agreement by Youthesta-Behala College and its affiliates shall be excused to the extent that such performance is hindered, delayed, or made impractical by flood, fire, war, or riot or any other cause beyond the reasonable control of Youthesta-Behala College or act of any third party beyond the control of Youthesta-Behala College including but not limited to hacking, data theft, unauthorised access to User account, impersonation, fraud, misrepresentation and so on.
16.1 You hereby agree, undertake and confirm that Youthesta-Behala College reserves the right to update, modify or suspend any part of this Agreement and/or Privacy Policy and/or Terms and Conditions from time to time. Such revised Agreement and/or Privacy Policy and/or Terms and Conditions shall be effective from the date of such update or modification or suspension. You hereby agree, undertake and confirm that Youthesta-Behala College is not under any obligation to notify You about any changes, modifications made in the Agreement and/or Privacy Policy. It shall be Your responsibility to regularly review the Terms and Conditions and/or Privacy Policy and/or Terms and Conditions for updates if any. If You disagree with any of the changes to the Agreement, You can refrain from accessing or using the Platform. Your continued access or use or availing of the Platform following the changes in the Agreement and/ or the Policies (including Privacy Policy, Terms of Use and Content Policy) will indicate Your acceptance and acknowledgement of the changes and You hereby agree, undertake and confirm that You shall be bound by the revised Agreement and/or the Policies.
