Centre was opposing of the same sex marriage concept in its affidavit as according to ‘Indian family concept’. According to Indian legislative petition marriage of biological man and women is possible which should not cause any damage to the delicacy balance of personal laws.
It also describes “despite the decriminalisation of Section 377 of the Indian Penal Code (IPC), the Petitioners cannot claim a fundamental right for same-sex marriage to be recognised under the laws of the country”.
The case was seeking to be filed in top court as the Supreme court had issued the petition in the last year of November and this year of January. The acceptance of same sex marriage was neither recognise not accepted. As per hindu and muslim marriage act only different caste marriage is accepted.
Finally the legislative decided to bring some rules to discuss about social, psychological and other aspects. It was ensured by the government to recognise such sacred relationships are debated and was considered by the legislature.
